If a vehicle owner discovers their new vehicle will not function as a result of a warranty nonconformity they may seek action on the manufacturer’s part as per the Alabama Lemon Laws. The Better Business Bureau may sometimes be called upon by consumers to act as an arbiter if they cannot find a resolution to the issue independently.
How To File
Step 1. Vehicle owners facing the daunting possibility of a lemon law dispute should make an effort early on to organize their documents.
Step 2. Consumers should set up a written log documenting various aspects of vehicle ownership such as performance, incidentals, and correspondence. Each entry should be dated and the log should be updated frequently.
Step 3. Typically, a consumer is expected by the Alabama Lemon Laws to inform the manufacturer as soon as possible of a warranty nonconformity. The manufacturer must be given ample opportunity to repair the warranty nonconformity. First contact should generally be in writing and made via registered mail with a return receipt request.
Step 4. Vehicle owners are required to issue a Final Notice to Repair, Replace, or Repurchase to the Manufacturer before pursuing them for compensation. The manufacturer has fourteen days from receipt to effect a permanent repair at this point. This should be sent by using registered or certified mail as it may be imperative to prove this was done.
Step 5. Some manufacturers will have a dispute process in place listed with the warranty if this is the case and it is 16 C.F.R. 703 compliant, the consumer is obligated to pursue this avenue before others. In most cases this will be a third party arbiter, the resulting decision is not binding to the consumer.
Step 6. If all else fails vehicle owners may wish to file a complaint with the Better Business Bureau Auto Line Program. Some manufacturers do not participate in this program but the Better Business Bureau will attempt arbitration regardless of this. One will be required to enter some basic information about location and the manufacturer. Once this is done select continue. This will direct the consumer to the correct area to file a complaint.
